The website https://www.sidrerias.ws is intended for all audiences.

Access

By means of this notice we inform visitors of the terms and conditions of use governing access to and consultation of our website. The owner of the website reserves the right to amend them at any time; those in force at the time of each visit shall apply, and the date of their last update is shown at the top of this page.

Access to sidrerias.ws is open and free of charge, and implies acceptance of these terms of use, the Legal notice, the Privacy policy, the Cookie policy and, if you publish anything with your account, the Community guidelines.

A user is any visitor to the website. We use the terms user and visitor interchangeably to refer to all users, although, when it comes to recognising rights and assuming obligations, we distinguish two types, depending on their interest in the visit:

• Consumer users: those who visit our website out of curiosity or in order to satisfy a personal interest, whether to obtain information, documentation, reading, viewing or personal consumption.
• Users with an economic or professional interest: those who visit it with the aim of obtaining any kind of professional gain or consideration of economic value, and those who visit it in the course of the activities of an organisation, whether public or private.

Within one and the same privacy policy, we accept and endeavour to comply with all provisions in favour of consumer users. Those who visit us with an economic or professional interest are excluded from the rights that correspond solely to consumers.

Every visitor undertakes to use this website in accordance with these terms, the law, public order, morality and generally accepted good practice.

User accounts

The website allows users and professionals to register. You must be 14 or over to open an account. By creating an account you declare that the information you provide is truthful and that you have the rights, powers and authority necessary to open it, in particular to manage an establishment’s listing on its behalf. You undertake to keep your information up to date, accurate and complete, to keep your password and the sign-in links we send you confidential, and not to allow third parties to access your account.

User accounts may have a username, which is unique and cannot be changed, a photo or avatar and a profile, which is private unless its holder decides to make it public. Professional accounts whose connection with an establishment we have checked are verified accounts: they can manage its listing and reply to reviews on behalf of the establishment.

We may cancel or suspend an account if we detect false or inaccurate information, identity impersonation, the use of third-party data without authorisation or breaches of the Community guidelines. You may delete your account at any time from “My details” and continue to use the website as a visitor.

Content published by users

People with an account can publish content on sidrerias.ws: their username, name, photo and profile and, when available, reviews, comments and replies. That content:

• Must comply with the Community guidelines, which form part of these terms.
• Is the responsibility of whoever publishes it. sidrerias.ws does not write it or check all of it before it is published, does not adopt it as its own and does not guarantee that it is accurate: it is its author’s opinion. When we have actual knowledge that content is illegal or breaches the guidelines, we will remove it diligently (Article 16 of Ley 34/2002 (LSSI) and Regulation (EU) 2022/2065 (Digital Services Act)).
• Remains its author’s. By publishing it, the author grants us a free, non-exclusive licence limited to showing it on sidrerias.ws, in all its languages, for as long as it remains published. The licence ends when the content or the account is deleted.

The official replies of a cider house or a cider maker are published by the person who manages its verified account, on behalf of the establishment, which is responsible for them. The establishment cannot remove or modify other people’s reviews: if it believes one breaches the guidelines or the law, it can report it like any other user.

Prohibited conduct

By way of example, and without this constituting a description of all prohibited conduct, the following are prohibited for visitors:

• Using the published email addresses to send unsolicited bulk email (spam).
• Sending information, content or opinions that breach the law in force, or that are false, inaccurate or misleading.
• Sending information, content or opinions that infringe the intellectual or industrial property of a third party or our own, or which there is no legitimate right to communicate and publish (because doing so would breach the law, a contractual obligation or a duty of confidentiality or secrecy).
• Impersonating a third party, in particular the owner of a cider house or a cider maker when requesting that their listing be added, modified or removed.
• Publishing fake reviews, about establishments one has not visited, about one’s own establishment or a competitor’s, or in exchange for consideration, and offering or requesting consideration for publishing, changing or removing a review.
• Sending illegal information or content, such as, without limitation:
  • content that denigrates on grounds of sex, race, colour, language, religion, political opinion, national or social origin, economic status, birth or any other condition;
  • content that is defamatory, insulting or slanderous towards natural persons or organisations;
  • content that breaches the law on pornography, sex, privacy, paedophilia, explicit violence, gambling, weapons, drugs, tobacco, alcohol or other activities prohibited by the legislator;
  • malicious and misleading content intended to create false conceptions or images of reality;
  • content that incites violence against people, animals or property, including content that may lead to self-inflicted injury or harm.
• Conduct aimed at illegal activities, such as:
  • sending harmful, malicious or dangerous computer programs, code or algorithms (viruses and any type of file or code capable of interrupting, destroying, compromising or limiting the functionality of devices, programs or networks);
  • manipulating or altering the website or its identifying data;
  • manipulating the visitor’s connections or identifying data in order to conceal their identity for the purpose of facilitating damage, misdemeanours, unlawful acts or criminal offences;
  • reverse engineering, interfering with the website, disabling its security measures, preventing its normal operation, or decrypting or decompiling the technical security measures implemented to administer and protect it.

Robots, search engines and data extraction

We want sidrerias.ws to be found: search engines and artificial intelligence assistants may crawl the website in compliance with the rules in /robots.txt, and we summarise its content for them in /llms.txt.

What is not permitted, without our prior written authorisation, is the mass or systematic extraction of the directory (scraping) in order to reproduce it, in whole or in part, in another database or service, or the use of tools that overload the server or ignore those rules. The directory is a database protected by the database maker’s sui generis right (Articles 133 et seq. of the Spanish Intellectual Property Act, Ley de Propiedad Intelectual).

For technical security reasons we may monitor the traffic the website receives and block any traffic that breaches these terms.

Other legal terms

In the event of a breach of these terms or of any content of our website, the owner reserves the right to take whatever legal and security measures it deems appropriate to protect its legitimate rights, including the right of exclusion, which consists of denying or withdrawing access to the website or its services without prior notice.

The translated versions of these texts are provided so that users can understand them in their own language. They do not replace the original Spanish version and have no legal validity of their own: in the event of doubts of interpretation or conflict, the Spanish version shall prevail.

For any matter or dispute arising from the interpretation, performance and enforcement of these terms, the parties submit to the jurisdiction and competence of the relevant courts and tribunals. If the user is a consumer, they shall be entitled to choose the forum granted to them by law. If the user is a natural or legal person with an economic or profit-making interest, the forum shall be that of the website owner’s registered address, in San Sebastián (Donostia).

Ending use of our website

The owner of the website reserves the right, without penalty and at any time, to modify or interrupt, temporarily or permanently, access to the website and its services.

Severability and entirety of the legal texts

If any of these terms is held to be invalid, void or, for any reason, unenforceable under the law, that clause shall be deemed severable and shall not affect the validity and enforceability of the remaining terms.
